Terms of service

These terms govern paid SNCAlert subscriptions sold at https://sncalert.com. Record of Sale, LLC, an Oregon limited liability company, is the owner and operator of the SNCAlert service and of sncalert.com. By creating a desk, starting Stripe Checkout, or using the service you agree to these terms and to the Privacy policy.

The product

SNCAlert emails and lists EPA-regulated facilities when a weekly ECHO Exporter snapshot newly shows Significant Noncompliance, High Priority Violation, or a new formal enforcement action or penalty. It is a sales and business-development list for environmental consultants and counsel. It is not a Phase I Environmental Site Assessment, not legal advice, not EPA advice, and not a substitute for reviewing ECHO or the source systems.

Plans and billing

Starter is $79 per month or $790 per year and covers three U.S. states you choose. Pro is $159 per month or $1,590 per year and is nationwide. Subscriptions are billed by Stripe. You can change plan or interval, update the card, and cancel in the Stripe Customer Portal. Access continues through the end of the paid period after you cancel. Taxes are not collected in Checkout unless Stripe later requires them for your location.

Refunds and cancellation

You may cancel anytime in the Stripe Customer Portal. Cancellation stops the next renewal; you keep access through the period you already paid.

Unused paid time is refunded through Stripe when you ask by emailing publisher@noticenearby.com from the desk address on the subscription, or when we process a refund in the Stripe Dashboard. Refunds go back to the original payment method Stripe has on file.

We may refuse or limit a refund, or suspend the desk, if we reasonably find chargebacks, payment fraud, credential sharing across unrelated firms, scraping, resale of the feed, or other abuse. A chargeback is not the same as a refund request; we will respond to disputes with the records Stripe provides.

Acceptable use

Use the list for outreach to facilities and their owners or operators. Do not scrape SNCAlert, resell the raw feed, share one login across unrelated firms, or present alerts as EPA determinations or as a Phase I ESA. We may suspend accounts that abuse the service.

ECHO data and reliance

SNCAlert uses EPA ECHO snapshots. ECHO data lag source systems, are not complete, and are not a substitute for a Phase I Environmental Site Assessment or other legal due diligence. This product is not EPA advice and is not endorsed by the U.S. Environmental Protection Agency. Do not rely on these alerts as a legal conclusion. Data source: U.S. EPA Enforcement and Compliance History Online (ECHO).

As-is limitation of liability

The service is provided as-is. We are not liable for missed flips, ECHO lag, incomplete source systems, or business decisions you make from an alert. To the fullest extent Oregon law allows, your exclusive remedy for a paid period you cannot use is a refund of unused paid time, processed through Stripe as described under Refunds and cancellation.

Governing law

These terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law rules. Courts located in Oregon have exclusive jurisdiction, except that either party may seek injunctive relief where the other party is located.
